IS IT REQUIRED TO HIRE A CONSTRUCTION SUPERVISION CONSULTANT IN VIETNAM?
Whether or not it is required to hire a construction supervision consultant depends on the type and scale of the project, as well as legal regulations in Vietnam. According to the Construction Law 2014 (Amended Law 2020 supplementing a number of articles of the Construction Law), it is stipulated as follows:
In Section 3. SUPERVISION OF CONSTRUCTION, ACCEPTANCE, AND HANDOVER OF CONSTRUCTION WORKS
Article 120. Construction supervision
1. Construction works must be monitored for quality, volume, progress, labor safety and environmental protection during the construction process.
For individual houses, the State encourages construction supervision (but is not required).
2. Construction supervision must ensure the following requirements:
a) Implemented throughout the construction process from the start of construction, during implementation until completion and acceptance of work and construction works;
b) Supervise construction works in accordance with approved construction designs, applicable standards, technical regulations, regulations on management and use of construction materials, technical instructions and construction contracts;
c) Honest, objective, not self-interested.
3. The selected construction supervision contractor must have proposals on supervision solutions and procedures for controlling quality, volume, progress, labor safety, environmental protection, inspection and testing procedures, collection, measures to manage documents and records during the supervision process and other necessary content.
Article 121. Rights and obligations of the investor in supervising construction works
1. The investor has the following rights:
a) Self-perform construction supervision when having sufficient construction supervision capacity and take responsibility for your own supervision;
b) Negotiate and sign construction supervision contracts; Monitor, supervise and request construction supervision contractors to properly implement the signed contract;
c) Change or request the consulting organization to change the supervisor in case the supervisor does not comply with regulations;
d) Suspend the implementation or terminate the construction supervision contract according to the provisions of law;
đ) Other rights according to the stipulations of the contract and relevant laws.
2. The investor has the following obligations:
a) Select a supervision consultant with qualified qualifications appropriate to the type and level of construction work to sign a construction supervision contract in case of not performing construction supervision yourself;
b) Inform relevant parties about the rights and obligations of supervision consultants;
c) Timely handling of supervisor's suggestions;
d) Fully implement the obligations agreed upon in the construction supervision contract;
đ) Store construction supervision results;
e) Compensate for damages when choosing a supervision consultant who is not qualified to supervise the project, accepting incorrect quantities, wrong designs and other violations that cause damage caused by them;
g) Other obligations according to the provisions of the contract and relevant laws.
