According to Article 23 - Decree 15/2021/ND - CP guiding detailed regulations on a number of contents on construction investment project management as follows:
Article 23. Investor organizes project management
1. The investor uses his/her legal status and affiliated professional apparatus with sufficient conditions and capacity to organize and manage construction investment projects. In case the implementation conditions are not met, the investor may hire an organization or individual with full capacity conditions as prescribed in this Decree to participate in project management.
2. The project management director must have sufficient qualifications as prescribed in Article 73 of this Decree, except in the case of managing a construction investment project that requires the preparation of an initial economic-technical report construction investment.
3. Individuals participating in project management work on a full-time or part-time basis according to the investor's decision and must have professional expertise appropriate to the job requirements.
Therefore, according to Article 23 of the above regulations, hiring construction investment project management consultants is not mandatory. There is no need to hire services when the Company has an affiliated professional apparatus with sufficient conditions and capacity to organize project management. If the Company does not qualify, the new investor must hire a qualified organization or individual to participate in project management.

DOES THE CONSTRUCTION PROJECT MANAGEMENT ORGANIZATION HANDLE THE ENTIRE PROJECT MANAGEMENT CONTENT OR A PART?
According to Article 24 - Decree 15/2021/ND - CP guiding detailed regulations on a number of contents on construction investment project management as follows:
Article 24. Hiring construction investment project management consultants
1. A project management consulting organization can undertake part or all of the project management content according to the contract signed with the investor.
2. The selected project management consulting organization must send a written notice of the duties and powers of the representative and the direct project management apparatus to the investor and relevant contractors.
3. The investor is responsible for monitoring the implementation of the project management consulting contract, handling related issues between the project management consulting organization, contractors and local authorities during the implementation process present project.
4. The selection of construction investment project management consulting contractors must comply with the provisions of the law on bidding for projects within the scope of the law on bidding.
Therefore, according to Article 24 above, a construction project management consulting organization can undertake part or all of the project management content, depending on what is signed concluded in the contract with the Investor.

FORMS OF HIRING CONSTRUCTION PROJECT MANAGEMENT CONSULTANTS
According to Article 20 - Decree 15/2021/ND - CP guiding detailed regulations on a number of contents on construction investment project management as follows:
Article 20. Choosing the form of construction investment project management
1. For projects using public investment capital, the person deciding on investment chooses the form of project management specified in Clause 2, Article 62 of the 2014 Construction Law, amended and supplemented in Clause 19, Article 1 of the Law. No. 62/2020/QH14, specifically as follows:
a) The investment decider decides to apply the form of specialized construction investment project management board, regional construction investment project management board (hereinafter referred to as specialized project management board, management board) regional projects) based on the quantity and progress of projects in the same specialty, same route, in an administrative area or at the request of the capital sponsor;
b) In case the project management form according to Point a of this Clause is not applied, the investment decider decides to apply the form of Investment Project Management Board to build a project or the investor organizes the management implementation project management or hire a project management consultant.
2. For projects using state capital other than public investment or other capital, the investment decider decides on the form of project management specified in Clause 1, Article 62 of the 2014 Construction Law, amended and supplemented. in Clause 19, Article 1 of Law No. 62/2020/QH14, in accordance with the management requirements and specific conditions of the project.
3. For projects using ODA capital or concessional loans from foreign sponsors, the form of project management organization is applied according to the provisions of international treaties on ODA or agreements with sponsors. In cases where international treaties on ODA or agreements with donors do not have specific provisions, the form of project management organization shall comply with the provisions of this Decree.
4. For PPP projects, the form of project management is implemented according to the provisions of Points a, b, c and d, Clause 1, Article 62 of the 2014 Construction Law amended and supplemented in Clause 19, Article 1 of the Law No. 62/2020/QH14 is consistent with management requirements, specific project conditions and agreements in the project contract.
Therefore, according to Article 20 above, construction project management consulting organizations have 4 forms of project management.

Article 73. Project management practice certificate
Individuals are considered for a project management practice certificate when they meet the conditions specified in Article 66 and Article 67 of this Decree and the conditions corresponding to the following classes:
1. Class I: Has worked as project management director of at least 01 project from group A or 02 projects from group B or higher in the field for which a practicing certificate is requested; or have one of three corresponding types of practice certificates (class I construction design; class I construction supervision; class I construction valuation) and have participated in project management of at least 01 project from group A or 02 projects from group B or higher in the field for which a practicing certificate is requested.
2. Class II: Has worked as project management director of 01 project from group B or 02 projects from group C or higher in the field for which a practicing certificate is requested or has one of three corresponding types of practicing certificates ( construction design class II; construction supervision class II; construction valuation class II) and has participated in project management of at least 01 project from group B or 02 projects from group C or 03 projects The project requires the preparation of an economic-technical report or more in the field in which a practicing certificate is requested.
3. Class III: Has participated in project management of at least 01 project from group C or higher in the field for which a practicing certificate is requested.
