SVG ENGINEERING APPLICATION OF REGULATIONS ON CONSTRUCTION INVESTMENT PROJECT
Regulations on formulation of construction investment projects under Article 52 Construction Law 2014 (amended 2020) are as follows:
(1) When investing in construction, the investor or the agency or organization assigned to prepare the project must make a construction investment feasibility study report, except for the cases specified in (3) and (4).
The contents of the construction investment feasibility study report must conform to the requirements of each type of project. The preparation of the construction investment feasibility study report must comply with other relevant laws and regulations.
(2) Before making a construction investment feasibility study report, the preparation of a construction investment pre-feasibility study report is prescribed as follows:
- Projects of national importance, group A projects using public investment capital; PPP projects in accordance with the law on investment under the mode of public-private partnership;
- Projects falling under the competence of the National Assembly or the Prime Minister to approve investment policies according to the provisions of the Investment Law must prepare a construction investment pre-feasibility study report;
- For projects not specified at Point a of this Clause, the preparation of the construction investment pre-feasibility study report shall be decided by the investment decider;
- The order of preparation and appraisal of the construction investment pre-feasibility study report shall comply with the law on public investment, the law on investment by the mode of public-private partnership and other provisions of law. related;
- The content of the construction investment pre-feasibility study report shall comply with the provisions of Article 53 Construction Law 2014, except for PPP projects.
(3) Construction investment projects only need to make economic - technical reports on construction investment in the following cases:
- Construction works used for religious purposes;
- Small-scale construction works and other works prescribed by the Government.
(4) Separate houses of households and individuals are not required to prepare construction investment feasibility study reports or economic - technical reports when they are built.
