CONSTRUCTION APPRAISAL PROCEDURE IN VIETNAM

According to Clause 10, Article 2 of Decree No. 06/2021/ND-CP guiding Construction Quality Management, Construction Works Implementation and Maintenance, construction appraisal is defined as construction inspection and evaluation of compliance with legal regulations on construction investment, conducted by competent state management authorities as stipulated in Decree 06/2021/ND-CP. Below is the standard construction appraisal procedure implemented by SVG Engineering for your reference:

CONSTRUCTION APPRAISAL PROCEDURE INCLUDES THE FOLLOWING MAIN STEPS

1. Appraisal Preparation

  • Define appraisal scope: Identify objectives, content, and requirements

  • Collect documentation: Including design drawings, construction contracts, site diaries, acceptance records, material certificates, etc.

  • Form an appraisal council or hire a specialized appraisal organization (if required)

2. On-site Construction Survey

  • Inspect current construction status: Compare with design documents and construction standards

  • Evaluate material and structural quality: Conduct visual inspections or specialized equipment tests (Using SVG Engineering's specialized construction quality testing equipment)

  • Document defects/non-compliance (if any): Prepare field reports with photographic evidence and measurements

3. Conduct Testing and Laboratory Analysis (if required)

  • Material and structural testing:
    Verify concrete strength, steel quality, foundation integrity, etc.
    (Compliant with construction material sampling regulations)

  • Field or laboratory testing:
    Employ non-destructive testing (NDT) methods or destructive sample testing

  • Results analysis:
    Compare findings against technical standards and specifications

4. Evaluation and Appraisal Report Preparation

  • Conclude construction quality assessment: Determine compliance status and identify any defects/non-compliance

  • Identify root causes of defects (if any): Design flaws, construction errors, material issues, or other contributing factors

  • Propose corrective measures: Repairs, remedial actions, or compensation claims as applicable

  • Prepare and distribute appraisal report: Submit formal documentation to all relevant parties

5. Announce Appraisal Results and Post-Appraisal Handling

  • Deliver results to the project owner, contractor, and relevant authorities

  • Propose remedial solutions and supervise implementation (if violations are identified)

  • Support dispute resolution and handle complaints (if required)

WHO HAS THE AUTHORITY TO CONDUCT CONSTRUCTION APPRAISALS?

The competent authorities responsible for construction appraisal are specified in Clause 2, Article 6 of Decree No. 06/2021/ND-CP on Construction Quality Management, Construction Implementation, and Building Maintenance, including:

- Provincial People's Committees shall organize construction appraisals for projects within their localities, except for the following cases:

  • Ministry of National Defense and Ministry of Public Security: Shall conduct appraisals for national defense and security projects.
  • Specialized Construction Management Ministries: Shall appraise construction projects when delegated by the Prime Minister.

​- The authority to lead incident cause appraisals shall comply with Clause 1, Article 46 of Decree No. 06/2021/ND-CP on Construction Quality Management, Construction Implementation, and Building Maintenance.

CONSTRUCTION APPRAISAL COSTS

Construction appraisal costs may include some or all of the following expenses as stipulated in Clause 3, Article 6 of Decree No. 06/2021/ND-CP on Construction Quality Management, Construction Implementation, and Building Maintenance:

a) The construction appraisal costs conducted by appraisal authorities include service fees and other remediation expenses required for the appraisal work;

b) Costs for hiring experts to participate in construction appraisal include travel expenses, accommodation fees at the work location, and expert service fees;

c) Costs for hiring organizations to conduct testing services for construction appraisal shall be determined through cost estimation in accordance with construction investment cost management regulations, and other relevant legal provisions, based on the scope of work specified in the testing program.

d) Other necessary expenses serving the appraisal process.

WHO BEARS THE CONSTRUCTION APPRAISAL COSTS?

According to Clause 4, Article 6 of Decree No. 06/2021/ND-CP on Construction Quality Management, Construction Implementation, and Building Maintenance:

The project investor, owner or facility management unit shall bear the cost of the appraisal. In case the appraisal results prove that the fault is caused by any relevant organization/individual, that party shall reimburse the appraisal cost corresponding to its responsibility and take remedial measures.
